It's 4 p.m. on a Friday, and the phone rings. You almost don't answer, and then wish you had not. It's Joe Smith, the firm's high-strung litigation partner, who is overwhelmed by a seemingly impossible ediscovery deadline. The judge in Acme Co. v. Big Insurance Ltd. has denied a request for a continuance, and Smith has two weeks to process documents.
Your first thought: "How do I deal with this massive amount of data without having to spend nights sleeping in my office to meet this deadline?" The answer, of course, is using project management techniques and established firm EDD protocols.
Because you've planned, you have an established discovery team to marshal. It includes your internal litigation support department (and probably your local outside vendor), attorneys, paralegals, document assistants, secretaries, and IT personnel. You've already created an organization chart, so people understand the important value they bring to the team. You are ready to review those massive files in an efficient, cost-effective, speedy process.
The next step is for the team leader(s) to meet with the client to discuss where key data might reside and what is discoverable. Common locations include: desktop and laptop computers, PDAs, cell phones, telephones, fax machines, backup tapes, hard drives, CDs, DVDs, flash drives, computer disks, digital cameras, GPS, and even iPods.

Expert Testimony May be Needed for E-Discovery Keyword Searches| WTN News |

In February 2008, a U.S. Magistrate Judge issued a decision that may add to the already expensive process of electronic data discovery in litigation. Now expert testimony may be required to determine the adequacy of keyword search terms used to identify and produce electronically stored information, or "ESI."
Corporate information technology staff and in-house lawyers are often forced to undertake the unenviable task of locating, organizing, searching, and producing all ESI relevant to a dispute. Locating and individually reviewing every e-mail sent or received by a potential witness can be exorbitantly expensive, and sometimes impossible to accomplish in the time permitted. The standard answer to this problem has been to conduct electronic keyword searches against the subject line and body text of the e-mails and other ESI.
The keywords used for such searches are selected in varying ways. Sometimes lawyers for a party requesting information will specify keyword searches. Other times, the producing party will attempt to determine the keywords itself. Often, search terms are negotiated or disputed.

Digital Universe to Explode by 2011 | IDC |
According to a recent article published on the AIIM Knowledge Center Blog, a leading research firm IDC has now released a revised version of last year's The Expanding Digital Universe white paper. The 2008 update finds that IDC's 2007 estimate for growth of the world's information content was too small. It turns out the 2007 digital universe was actually 281 billion gigabytes, about 10 percent bigger than IDC thought.
By 2011, IDC says in its new report, the digital universe will grow to 10 times its 2006 size. Their track record so far means that this estimate will prove an underestimation as well.

Emerging E-Discovery Market Grows More Vital for VARs

Note that IT Channel Planet is a new online publication from Jupiter Media targeted to IT channel resellers. For its first issue, writer Herman Mehling addresses electronic discovery as an opportunity for channel players to offer a range of technology-enabled solutions that are increasingly in demand by corporations today.
The little-known market of electronic discovery (eDiscovery), which involves compiling, storing and securing digital information, is emerging as a key opportunity for channel players.
Growth in the market is being fueled by the need for corporations to comply with recent amendments to the Federal Rules of Civil Procedure (FRCP) covering the discovery of digital information.
Those amendments, which took effect in December 2006, compel companies to do precise and exhaustive recordkeeping. Under the new rules, for example, a judge or jury can assume a company is hiding information if it can't provide emails deemed relevant to a lawsuit in which it is involved.
That development has turned many companies to seek help from VARs and other channel partners knowledgeable about this developing vertical market...

Features New Productive ReviewTM Process for Increased Efficiency and Greater Return on Investment during eDiscovery Document Review
During the recent ABA TechShow in Chicago, ONSITE3 previewed new review management capabilities - including workflow customization and productivity metrics - for its upcoming eViewTM 2.0 release. The new release of ONSITE3's leading document review platform is expected to become available in late March 2008.
"ONSITE3's new eView release demonstrates our commitment to providing clients with increasingly more effective electronic evidence solutions for better management of the risk and cost associated with complex litigation and regulatory compliance," said Robert Ballou, chief executive officer, ONSITE3. "eView's improved review management capabilities will allow attorney review teams to operate more efficiently and collaboratively than with other review solutions on the market today."
"eView offers our clients many important features they need but cannot find in other review tools, such as flexible and client customizable workflow management capabilities," said Debra Rozier, vice president of ASP services, ONSITE3. "By working closely with our clients, eView 2.0 is now set to deliver even more innovative functionality and performance that clients need for addressing their document review and repository hosting requirements."
New workflow features that will be available in the upcoming eView 2.0 release include:
- Highly Flexible Review Workflows: eView 2.0 enables clients to manage multiple review teams and allows for added depth in the levels of review beyond the traditional 1st and 2nd levels, extending to 3rd, 4th, 5th, and so on. This multi-team functionality can support parallel style reviews where different teams can review the same set of documents simultaneously for different kinds of issues. In addition, these workflows can be utilized in sequential, non-sequential, or bi-directional order for a fully customizable and flexible approach to the review process.
- Improved Filtering Capabilities: Clients now have full control over what documents are included or excluded from review; this can also be customized by 1st or 2nd level review teams.
- Improved Folder Prioritization: Clients gain much greater flexibility when assigning documents to reviewers. For example, higher priority documents can be set up so that reviewer assignments will pull from these documents first.
- Customizable Batch Sizes: The new release permits clients to customize batch sizes for each 1st or 2nd level review team. This capability can facilitate larger batches for 1st level teams that tend to review documents more rapidly, while also providing smaller populations of documents for 2nd level teams that generally conduct more focused reviews.
- Enhanced Tagging Template: eView 2.0 offers enhancements to the pre-defined tag template to enable clearer categorization of review calls and easier determination of which teams reviewed which documents. The release also provides the ability for reviewers to tag documents without disrupting the review workflow.
- Expanded Productivity Metrics: We have added several new metrics and methodologies for tracking review progress across an entire project, for specific levels or teams and even down to the individual reviewer.

ONSITE3 Adds New Vice Presidents for eDiscovery Technology and Human Resources |
ONSITE3 recently promoted Christopher Jurkiewicz to the position of Vice President of eDiscovery Technology. Previously, Mr. Jurkiewicz held the position of Director of Electronic Discovery. Jurkiewicz is now responsible for the architectural design and development of the company's Electronic Evidence Enterprise (E3) eDiscovery platform, including deployment of updates, training, creation of throughput metrics, and standardization of processes and client delivery methodologies. Jurkiewicz is also heavily involved in eDiscovery project planning and implementation.
As an 8+ year veteran of the litigation support service industry, Mr. Jurkiewicz has been progressively promoted from his beginnings in ONSITE3's data delivery department where he helped standardize procedures and created workflow processes, such as for achieving greater efficiencies when merging scanned documents with coded and electronically produced data. Later Jurkiewicz was central to the creation of ONSITE3's Electronic Data Discovery (EDD) service and spearheaded client requests and enhancements to the company's eDiscovery processing service. Jurkiewicz holds a Bachelor of Science degree in Computer Information Systems from Marymount University.
In addition, ONSITE3 promoted Cristal Kurtz to the position of Vice President of Human Resources. Previously, Ms. Kurtz held the position of Senior Director of Human Resources. Kurtz is now responsible for leading the company's collaborative efforts for national employee relations, staffing and recruitment, compensation and benefits, and payroll. Leading up to her promotion, Kurtz successfully drove development of updated benefits offerings, highly competitive recruitment efforts, an increased sense of team culture across all company locations, and an outstanding employee retention rate.
Prior to ONSITE3, Ms. Kurtz has strong experience in corporate employee relations for a major national non-profit organization and in developing the human resources infrastructure in the pre-IPO, high-growth, hi-tech dotcom and aerospace industries of the West Coast region. Her prior accomplishments include domestic and international human resources management, corporate compensation and benefits program development, succession and retention planning, developing international and multi-site recruiting infrastructure, and building reward programs to encourage client centric behaviors. Kurtz holds an undergraduate degree from The University of Texas at Austin and a Masters Degree from Southwest Texas State University as well as a certification as a Senior Professional in Human Resources Management (SPHRM).

ONSITE3 eDiscovery Expert Teaching eDiscovery Course for Insurance Agencies |
As a prelude to the upcoming 32nd annual AMS Users' Group National Conference in Reno, Nevada (being held April 13-16), the AMSUG published a short interview with Jeffery Fehrman (President of EELabs, a division of ONSITE3) in the group's Nov/Dec 2007 issue of User-to-User magazine. The interview is primarily intended to promote a two-part eDiscovery educational course that Mr. Fehrman will be conducting during the event on behalf on Iron Mountain, who is sponsoring the course. Attendees will be members of the AMSUG, which represents more than 11,000 independent insurance agencies that use AMS Services agency management systems.
