White House E-Discovery Squeeze Puts Email Backup in Focus | ComputerWorld
|
Experts say many organizations lack urgency to archive e-mail, handle discovery requests
As the White House contends with a federal judge's order to prepare a discovery plan amid a legal skirmish about missing e-mail, storage experts say businesses should move to improve backup and e-mail archiving policies to avoid similar legal problems.
District Court Judge Colleen Kollar-Kotelly this week issued an order enabling the Washington-based Citizens for Responsibility and Ethics watchdog group to perform limited questioning of White House officials. The group last May had filed suit against the White House Office of Administration seeking access to White House e-mail under the federal Freedom of Information Act.
The nonprofit group had been seeking White House e-mail documents related to various controversial issues, including the release of the identity of a former CIA operative, the reasons for launching the war in Iraq and actions by the U.S. Department of Justice. The White House has contended that the e-mail requested by the group has been lost.
Kollar-Kotelly ordered the discovery to determine whether the Office of Administration is subject to the Freedom of Information Act. The office contends it is not subject to FOI requests.
The watchdog group and the White House were ordered by the judge to submit a discovery plan to the court by Feb. 21.
Mike Osterman, president of Black Diamond, Wash.-based Osterman Research Inc., said many businesses operate under the false assumption that e-mail is not a business record. He said that most business and IT managers fall short of creating adequate e-mail archiving and policy-based data-retention processes.

ABA Approves Uniform Rules Relating to Discovery of Electronically Stored Information| Uniform Law Commission |

The ABA approved the Uniform Law Commission's Uniform Rules Relating to Discovery of Electronically Stored Information. The uniform rules on e-discovery should bring up-to-date the state rules and statutes concerning discovery of electronic documents in civil cases.With the emergence of electronic technology, the extent to which individuals and institutions store or maintain information in an electronic form has clearly increased since the adoption of rules governing discovery generally. By some estimates, more than 90% of corporate information is being stored in some sort of digital or electronic format. This new act mirrors the recently adopted amendments to the Federal Rules of Civil Procedure dealing with electronically stored information.

E-Discovery: Current Trends and Cases
Akerman Senterfitt shareholder Ralph Losey, based in Orlando, has written and released "E-Discovery: Current Trends and Cases," based on his popular weekly blog, "e-discovery Team" at www.ralphlosey.wordpress.com. The book has already been cited in an Opinion handed down from the United States District Court for the District of Columbia.
The American Bar Association published the book and describes it as the world's first legal "blook," which is a book derived from a blog and represents a new trend and genre in mainstream publishing. Several recent non-fiction bestsellers have reportedly been derived from the authors' blogs.
According to a press release, "E-Discovery: Current Trends and Cases" is intended to help bridge the knowledge gap between the disciplines of law and information technology (IT) so that the challenges of electronic discovery can be met. The book explains the latest trends and cases and outlines the new interdisciplinary team approach to solving the unique problems of e-discovery.
The book also covers the new ethical standards for e-discovery, new federal rules of civil procedure, search and review of electronically stored information (ESI) and new technologies. It is also the first book on e-discovery to include the opinions and analysis of many leading experts in the field, not just those of the author.

As a prelude to the upcoming 32nd annual AMS Users' Group National Conference in Reno, Nevada (being held April 13-16), the AMSUG published a short interview with Jeffery Fehrman (President of EELabs, a division of ONSITE3) in the group's Nov/Dec 2007 issue of User-to-User magazine. The interview is primarily intended to promote a two-part eDiscovery educational course that Mr. Fehrman will be conducting during the event on behalf of Iron Mountain, who is sponsoring the course. Attendees will be members of the AMSUG, which represents more than 11,000 independent insurance agencies that use AMS Services agency management systems. The national conference tends to attract close to 2,600 participants. Details about the national conference are available from the AMSUG web site at www.amsug.org.
"In our two-part class, we're going to talk about what eDiscovery is, technical and legal considerations, and how to proactively prepare. This is not a time an agency wants to be reactive," Fehrman said. "Then, we'll give agents a checklist of what they need to do, and some alternatives for archiving their electronic files, which is where Iron Mountain comes in."

Freeware eDiscovery Tool: EDRM XML Load File Converter |
As announced in a press release during LegalTech New York 2008, ONSITE3 is now providing a FREE tool for converting to or from the EDRM's new XML load file format and existing Concordance Opticon and other delimited text load file formats. What this means is that if the EDRM's XML format should be required for production of electronic evidence in one of your cases, you could use this tool with your existing applications in order to accomplish the task. No expensive upgrades, significant effort, or vendor involvement are required.
Available as freeware, there is no cost or other obligation required in order to use the tool, nor is there any associated trial period. ONSITE3 is simply providing the tool for free via download to anyone who submits an online registration form from its website. Future enhancements to the tool are also planned, including support for conversion from additional load file formats.
Limited technical support is available for this free tool via phone or email. Specific support contact details are provided after registration to download the tool has been submitted.
